Boot Camp Death

Toxic Torts: Injuries from Toxic Substances

Over the past century, our world has seen a number of industrial advances that have improved both the length of our lives and our standard of living. Unfortunately, an unintended byproduct of these industrial advances has been an increasing number of dangerous and toxic substances polluting our environment. Although you may recognize the names of some of the most famous (or infamous) disasters. Disasters such as Love Canal or Three Mile Island. There are hundreds if not thousands of sites all over the United States that are too contaminated with toxins to be used. Sites which await cleanup by the Environmental Protection Agency. Perhaps you unknowingly live near one of these contaminated sites…Continue reading

BICYCLE SAFETY

Firstly, bicycles traveling on a road are required to be treated the same way as any other vehicle traveling on the road. This means that bicyclists need to obey the same laws as other drivers. Don’t run red lights, change lanes without signaling, or commit other infractions. Furthermore, If you would not do it in a car, don’t do it on a bike…Continue reading

YOUR RIGHTS AS A TENANT

Unfortunately, disputes between landlords and tenants are not uncommon. And due to them involving tenants’ homes they can often become emotional. First of all, getting into a lawsuit with your landlord is never fun, and so, in order to prevent unnecessary disputes, it is helpful to know your rights as a tenant…

Even though all Texas motorists are required to have automobile insurance, it is hardly a secret that not all drivers obey the law. To protect yourself if you are hit by another driver who does not have any insurance, or who does not carry enough insurance to pay for all of the damages his negligence causes, it is a good idea for you to carry uninsured and underinsured motorist insurance coverage…Continue reading

Wrongful Death Case Study

Brad was a mechanic called to a gravel mine to repair the brakes on a dirt hauler. Brad was heating the rim of the wheel hub with a torch to get it unstuck and the heat caused the tire to explode. Horribly injuring–and eventually killing–him. Brad’s close-knit family was devastated and sued the mining company for failing to provide Brad with proper training…Continue reading

WRONGFUL DEATH LAWSUITS

In short, at one time or another, you will likely have to deal with the inconvenience of having suffered some minor injury. Slipping on a spill at a store and twisting your ankle. Possibly a fender-bender in afternoon traffic, and the like. However, sometimes you are faced with a far more serious situation, such as injuries that lead to a family member of yours being killed. In such cases, if someone else is responsible for the injuries, a wrongful death suit can be filed…Continue reading

Aggressive Driving

As roads become more congested and people’s lives become more hectic, aggressive driving, also known as “road rage”, and the dangers associated with it increase. To clarify, aggressive driving is the combination of unsafe and unlawful driving actions that show a disregard for safety. An aggressive driver is one who operates his or her vehicle in a selfish, bold, or pushy manner, without regard for the rights or safety of others…Continue reading

Birth Injuries

Pregnancy and childbirth have inherent risks and can result in complications and injuries to the mother and the child. All injuries suffered during birth are devastating, but some birth injuries are the result of mistakes made by obstetricians, doctors, nurses and other health-care providers. You may have a legal claim for damages for yourself and your child if…Continue reading

Comparative Negligence

“Comparative negligence” is a term often used in connection with a lawsuit, but many of us don’t really know what it means. The idea is fairly simple, but any explanation of comparative negligence must start with a simple definition of “negligence.” A person is negligent when he or she owes someone else a duty to act in a certain way but doesn’t live up to that duty and carelessly causes an injury to the other person. Depending on the circumstances, the law imposes different standards of care on people, including (1) ordinary care (the care exercised by a reasonably prudent person), (2) high degree of care (the care owed by some highly-specialized professionals), or (3) a child’s degree of care. If the injured person elects to sue the careless person, the lawsuit is a negligence suit…Continue reading

Diminished Value of a Vehicle

Most of us have experienced the nightmare of a “fender-bender.” Even if you are lucky enough to escape physical injury, a simple car accident can still lead to problems, aggravations, frustrations, and inconveniences. You may find yourself without a vehicle or with a vehicle that needs repairs. You may struggle with insurance companies in order to get a property settlement. Even after your vehicle has been repaired, it remains damaged in your eyes and in the eyes of others. It has lost that new feel and look. When you try to sell it, potential buyers will be suspicious of the repairs and may be leery of buying a previously “wrecked” vehicle. Unfortunately, there is not a thing you can do about it except to drive defensively and stay out of accidents…Continue reading

Lead Poisoning

Lead is a highly toxic metal that can be found in many products and materials in our homes and businesses. The primary source of lead poisoning in the human environment is lead-based paint, but lead can also be found in the dust and soil where lead-based paints have peeled off or have been disturbed, as well as in some types of plumbing materials. Although Congress passed laws prohibiting the manufacture and use of lead-based paint in 1978, many buildings and homes built before this ban still contain significant amounts of lead-based paint. This lead in our environments poses the danger of causing lead poisoning…Continue reading

Construction Injuries

Construction is one of the largest industries in the United States, employing over six million people nationwide, and is a vital part of our economy. However, being a construction worker is also one of the most dangerous occupations, with over 8,000 people killed on job sites every year (about 1,200 in Texas alone) and thousands more injured. The impact of these injuries can be devastating, not only to the worker but also to the family that depends on him and the paycheck he brings home every week…Continue reading

So what is the real deal on diet drugs?… Continue reading

Insurance Company Bad Faith

Most of us carry insurance–on our home, our car, our lives. The insurance company who sold you the policy probably tried to tell you that it was selling you peace of mind. You make your payments every month and then when you finally do have a claim–surprise–it is denied. Sometimes the denial is proper because the claim truly is not covered. Many times, however, the denial is improper, and the claim you have made really should be covered by the insurer to whom you have paid all those premiums. What then?… Continue reading

Child-Care Dangers

It is an unfortunate fact that those most vulnerable and least able to protect themselves are often those at the highest risk of abuse or neglect. Moreover, elderly persons confined to nursing homes, the mentally ill and the retarded, and the very ill are often targets for abuse or the victims of neglect because they are least able to protect themselves. To this list, we can add one more group: children in daycare. While the vast majority of child-care facilities and child-care providers are trustworthy and responsible, cases of abuse or neglect, while rare, do occur…Continue reading

Governmental Negligence

With the government involved more and more in our lives, there is an increased chance that you could be injured because of the government’s negligence. Since the Middle Ages, the law of England has followed the edict that the “king can do no wrong,” and, thus, if you have been hurt by the king or his agents, that is your own bad luck. Although the United States has no king, we do follow English law, including this idea of “sovereign immunity.” In its modern form, sovereign immunity prevents people from suing the government unless the government gives them permission to do so…Continue reading

Is It an Accident or a Motor Vehicle Accident?

Although the answer to the question of just what is a “motor vehicle accident” seems obvious (just look for the dented fender), this is not always the case. The Texas Supreme Court recently had to decide whether a person who was injured when he got stuck while getting out of his truck had actually been in an auto accident

Death, Burial, and Texas Law

Because most of us do not like to talk about death, people often die leaving their loved ones uncertain about their responsibilities and the wishes of the recently deceased. In an effort to make things easier, here are some frequently asked questions about death and burial…

Minor children do not have the legal capacity to bring a lawsuit on their own. Any time a lawsuit needs to be brought for injuries caused to a child, such as by a negligent doctor or driver, the suit must be filed by a competent adult, who may be the child’s parent, guardian, or even a person called the child’s “next friend,” which just means anyone with an interest in the child’s welfare…

Child Resistant Products

First of all, just because a product is advertised as being “child resistant” does not mean that it cannot cause harm. In a case recently decided in Texas, a young girl was severely injured when her brother began using a supposedly child-resistant lighter to melt crayons and accidentally set his sister’s dress ablaze. The sister suffered serious burns over 55% of her body. A lawsuit was brought against BIC, who manufactured the lighter…Continue reading

Although doctors complain that malpractice insurance has become expensive because of malpractice damages awards, Congress’s solution causes more problems than it solves…Continue reading
